Terms and conditions
The agreement between you and CarQuant.
This site is operated by CarQuant (ABN 93 189 088 397). By accessing or using CarQuant you agree to these Terms and Conditions. If you do not agree, do not use the site.
We may amend these terms at any time by publishing an updated version on this page. Continued use after an amendment takes effect constitutes acceptance of the amended terms. The date at the head of this page indicates when it was last revised.
CarQuant is provided for your personal, non-commercial research. You may view reports, run comparisons and analyse listings for your own purposes.
You must not scrape, harvest, bulk-download or systematically extract the vehicle database, scores or any part of the site; resell, sublicense or redistribute CarQuant output as your own product; use automated systems to access the site other than conventional search engine indexing; reverse engineer the scoring model; or use the site in a way that interferes with its operation or another user's access.
Some features may require an account. You are responsible for the accuracy of your registration details, for keeping your credentials secure, and for all activity under your account. Notify us at nicholas@carquant.com.au if you believe your account has been compromised.
CarQuant sells one paid product: a listing report, commissioned and paid for once, at the price disclosed at the point of purchase. There is no subscription, no recurring charge, and nothing to cancel. Except where the Australian Consumer Law requires otherwise, fees already paid are not refundable, and nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law.
We may vary the price of the report, or what it includes, on reasonable notice. A change applies only to commissions placed after it takes effect and never to one already accepted.
The CarQuant name, the site, its design, the scoring methodology, the weightings, the Annual Cost of Access calculation, the vehicle database and all scores and derived figures are the intellectual property of CarQuant or its licensors, and are protected by Australian and international copyright law.
Underlying facts, such as a recorded auction result, are not owned by us. Our compilation, selection, arrangement and scoring of that material is. You may quote a small portion of a report for the purposes of fair dealing under the Copyright Act 1968 (Cth), with attribution to CarQuant.
Vehicle photographs are reproduced under the licences their photographers selected. See the photo credits page for file-level attribution.
When you paste a listing, ask a question or otherwise submit material, you retain ownership of it. You grant us a non-exclusive, royalty-free licence to process, store and analyse that material in order to provide the service, and to use de-identified and aggregated derivatives of it to improve the model.
You warrant that you have the right to submit what you submit, and that it does not infringe a third party's rights. Do not submit personal information about other people, confidential material, or content you are contractually prohibited from disclosing.
We may remove submitted content at our discretion, and we do not undertake to store or retain it.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Subject to that, CarQuant is provided on an as-is basis. We do not warrant that scores, valuations, projections or any other output are accurate, complete or current, and we exclude all implied terms to the maximum extent permitted by law.
Where our liability may lawfully be limited, it is limited at our option to resupplying the service or paying the cost of having it resupplied. To the maximum extent permitted by law we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, or any capital loss arising from a vehicle purchase, sale or holding decision.
We may suspend or terminate your access, with or without notice, if you breach these terms, if we reasonably suspect misuse, or if we discontinue the service. You may stop using CarQuant at any time.
Clauses concerning intellectual property, limitation of liability and governing law survive termination.
These terms are governed by the laws of South Australia. You and we submit to the non-exclusive jurisdiction of the courts of South Australia and the courts competent to hear appeals from them.
